Chapter 14

Read online bio's of the U.S. Supreme Court Justices.  What do you find interesting about their backgrounds?  Pick one of the Justices, read about cases this Justice has written (majority or dissent) and explain whether you agree or disagree with his/her judicial philosophy.

I find it so interesting that people that President Reagan nominated to be justices are still there today. I know in the things you read it often says they serve for life but it just doesn't seem real until you realize a great president like Reagan nominated people who are still serving today! Being a woman I decided to look up information on Ruth Bader Ginsburg. Based on looking through her cases it was clear she was for woman's rights. Which obviously I firmly believe in! 

Is Judicial Review a power that should be exercised regularly or sparingly?  Why?

I think like many other things its better in moderation. I believe it is wonderful because it can ensure that unconstitutional aren't passed. This is all about checks and balances. I believe this power should only be used when necessary. 

Is it the job of the High Court to apply the Constitution in light of the intent of the framers of the Constitution (strict construction) or should they interpret the Constitution in light of changes in society/technology (living Constitution)?  Why?

Shew this is a tough one. I believe some things need to be in strict and stay the same. Like our basic freedoms. Speech and right to own guns, those type of things. However things are different since the Constitution was created. I think it is appropriate for some things to change with the times. It's not the same world it was then.

  2. Wow, you made me feel old lol. I was a little girl when Reagan was in office. Anyway. I agree with you about the Constitution. In many ways it should be taken strictly as the framers intended. But of course things have changed and new technologies exist but I think that is why they were rather vague on some things, so that they could be left open to interpretation.
